LEGAL INFORMATION

Software licensing.

The basis on which MyEvent Labs software is licensed, supported and used.

Last updated:

1. When these terms apply

These terms apply to MyEvent Labs software where they are expressly incorporated into the licence or agreement supplied before you commit to the transaction. They do not grant a licence merely because you visit this website. The online shop does not currently sell software licences or subscriptions.

Your product licence or project agreement identifies the licensor, software, permitted users or devices, licence duration, fees and any special conditions. Those agreed terms prevail over this page if they conflict, subject to rights that cannot lawfully be excluded. Bespoke development is governed by its project agreement, including ownership and source-code arrangements.

2. Permitted use

Subject to payment of the agreed fees and compliance with the agreed terms, you receive a non-exclusive licence to install and use the software within the scope of your product licence. Commercial use is permitted where it falls within that scope. You may make reasonable backup copies and allow authorised personnel to use the software within the agreed user or device limits.

A licence gives you permission to use the software; it does not transfer ownership of its copyright. It does not give MyEvent Labs ownership of your existing material, business data or content you create using the software. Ownership of commissioned deliverables is addressed in the project agreement.

3. Restrictions and rights reserved by law

Except as permitted by your licence or by law, you must not distribute, resell, sublicense or make the software available to unauthorised users; remove ownership notices; or bypass licence controls to exceed the agreed scope. You must not use the software for unlawful purposes or to infringe another person’s rights.

Restrictions on copying, modification, reverse engineering or decompilation do not apply to conduct permitted by a law that cannot be excluded by agreement. This includes applicable rights under the Copyright Act 1968 (Cth) concerning interoperability, error correction and security testing. Contact us if you need broader deployment or transfer rights.

4. Third-party and open-source components

Software may include components supplied under separate licences. Their notices and terms will be supplied with the software or its documentation. Where a third-party or open-source licence grants rights in a component, these terms do not take them away. Any source-code access required by that component’s licence will be provided as that licence requires.

External services may require a separate account, subscription or licence. Required dependencies and known compatibility requirements will be identified before purchase. A third-party dependency does not remove our obligations for software or services we supply.

5. Delivery, updates and support

The product description or agreement sets out delivery, activation, supported environments, included updates and support. A licence does not by itself promise every future version, ongoing hosting or indefinite technical support. Any limitations must be disclosed before purchase and remain subject to our express commitments and statutory obligations.

Please maintain appropriate backups and apply updates in accordance with the documentation. We will not treat a missed update or an unrelated modification as automatically extinguishing consumer rights. Issues will be assessed on their cause and the applicable legal rights.

6. Duration and charges

The licence duration and fees must be stated in your agreement. A perpetual licence permits continued use of the licensed version, subject to its terms; it does not itself include future versions or continuing services. A fixed-term licence runs for the stated period. No recurring payment is authorised by these general terms. Any future subscription must separately disclose its billing, renewal and cancellation arrangements and obtain your agreement.

7. Breach, suspension and termination

If either party materially breaches an agreement incorporating these terms, the other may give written notice identifying the breach and a reasonable opportunity to remedy it. Termination may follow if the breach remains unremedied. This does not limit a right to end an agreement for a serious breach that cannot be remedied, or under consumer law.

Any suspension to address a security threat or unlawful use must be necessary and proportionate. Where practicable we will give notice, explain the reason and restore access when the issue is resolved. Raising a complaint or seeking a statutory remedy is not a breach.

When a licence lawfully ends, use of the affected software must cease and copies must be removed, except for records required by law and components you may independently use under another licence. Where we host your data, we will provide a reasonable opportunity to export it before access ends, so far as lawful and technically practicable. Accrued rights, refund entitlements and ownership of your data remain unaffected.

8. Consumer guarantees and remedies

Nothing in these terms excludes a guarantee, right or remedy under the Australian Consumer Law or another law where exclusion is prohibited. Software is not supplied on a basis that removes those protections. Remedies for a fault or failure are explained in our Returns & warranty policy. Activation or download does not waive an entitlement to a remedy.

9. Changes and disputes

Updating this page does not change an existing licence. A material change to an agreed licence requires agreement, except to the extent required by law. Victorian law and applicable Commonwealth law govern these terms, without removing any mandatory protections or right to bring proceedings in another competent court or tribunal. Please contact us to discuss licence questions or a dispute; doing so is not a precondition to exercising your legal rights.
